eBags “Holiday Wishlist Pin It To Win It” Giveaway Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY IN ORDER TO ENTER OR WIN THIS Giveaway. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING THIS Giveaway. VOID WHERE PROHIBITED.
Please read these Official Rules before entering the eBags “Holiday Wishlist Pin It To Win It” Giveaway (the “Giveaway”). By submitting an entry, you agree that you will be bound by these Official Rules and you acknowledge and represent that you satisfy all Giveaway eligibility requirements as set forth herein.
Giveaway Sponsor. eBags, Inc. (”we” or “us”), 5500 Greenwood Plaza Boulevard, Suite 160, Greenwood Village, CO 80111.
Giveaway Eligibility. If you are an individual, legal resident of the 50 (fifty) United States or the District of Columbia and are 18 (eighteen)years of age or older at the time of your entry, you are eligible to enter the Giveaway. Our employees, their immediate family members (spouses, domestic partners, parents, guardians, grandparents, siblings, children and grandchildren), and our affiliates, advisers or advertising/promotion agencies (and their immediate family members) are not eligible to enter the Giveaway.
Method of Entry. You may enter the Giveaway beginning at 12:00:01 a.m. (MDT) on [Thursday], November 8th, 2012 and ending at 11:59:59 p.m. (MDT) on [Friday], November 30th, 2012 (the “Giveaway Period”). In order to enter the Giveaway, during the Giveaway Period you must: Log in to your eBags® account, ”Follow” the eBags Pinterest® page (http://pinterest.com/ebags/), Create a eBags Wishlist, Wishlist must be a minimum of 10 items from eBags.com to qualify, Pin your eBags wishlist to your Pinterest Board. Use Hashtags #eBags and #ebagswishlist to qualify. Limit one entry per customer during the Giveaway Period. You may not use more than one customer account to enter the Giveaway, and entries submitted through multiple accounts will be disqualified.
Giveaway Prize. We will award 1 random winner a $1,000.00 gift card to eBags.com . The approximate retail value $1,000.00.
Giveaway Prize Drawing. The potential winner will be determined by random selection on [Friday], November 30th, 2012. We will notify the potential prize winner by e-mail within 1 (one) business day following the drawing, and he/she will be required to respond within set time period to receive the $1000.00 Gift Card. We will select an alternative potential prize winner if the potential prize winner does not respond within the given time period. The prizes will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchant ability or fitness for a particular purpose).
Odds of Winning Giveaway. The odds of winning depend on the number of eligible entries received for the Giveaway for a given day.
Additional Terms. We may, to the maximum extent permitted by applicable law and in our sole discretion, change or amend these Official Rules or cancel the Giveaway at any time; or modify, terminate, or suspend the Giveaway should viruses, worms, bugs, unauthorized human intervention or other causes beyond our control corrupt or impair the administration, security, fairness or proper play of the Giveaway or submission of entries. We are not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Giveaway, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Giveaway; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to your or any other computer resulting from downloading any materials in connection with the Giveaway. We may, in our sole discretion, disqualify any individual found to be: (x) tampering with the entry process or the operation of the Giveaway or website; (y) acting in violation of these Official Rules; or (z) acting in an unfair or disruptive manner or with intent to annoy, abuse, threaten or harass any other person or entity. If your entry is incomplete or if you use robotic, automatic, programmed or similar entry methods, your entry will be void. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Giveaway at the actual time of entry will be deemed to be the participant and must comply with these Official Rules. The authorized email account subscriber is the natural person who is assigned an email address by an Internet access provider, on-line service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted email addresses. No greater than the number of prizes stated in these Official Rules will be awarded. If any technical errors occur in the selection of a potential prize winner or if more prizes are claimed than the number of prizes being awarded as provided in these Official Rules, we may award the prize by random drawing from among all eligible claimants.
Miscellaneous. The Giveaway is governed by the laws of the United States. The Giveaway and all accompanying materials are © 2012 by eBags, Inc., and its affiliates. All rights reserved. If you win a prize, you may not transfer, assign, or redeem the prize for cash. We may substitute a prize with a prize of equal or greater value. To the maximum extent permitted by law, the prize winner agrees (for himself or herself and his or her heirs) that, by accepting the prize, we, along with our affiliates and agents, will have no liability, and will be defended, indemnified and held harmless by the prize winner for any liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize or participation in the Giveaway, even if caused or contributed to by our negligence. You agree that our decisions related to the Giveaway and all drawings are final. The prize winner agrees that, by his or her participation in the Giveaway, we may use the prize winner’s name, image or likeness in any manner and in any medium for our promotional purposes without additional compensation, except where prohibited by law.
Prize Winner’s List. After we confirm the prize winner, we will post the Prize winner’s name on our Facebook page.
Other Giveaway. Please note that we may be running similar Giveaway at the same time as this Giveaway. By entering this Giveaway, you will not be eligible to receive any prize awarded in any other Giveaway unless you enter each Giveaway separately.
Mailing List and Privacy Notice. By entering the Giveaway, you consent to being placed on a mailing list for promotional materials, including catalogs, for eBags.com. You may update or change your Email Preferences at Your Account on eBags.com. All information submitted in connection with the Giveaway will be treated in accordance with these Official Rules and our Privacy Policy.
